these terms govern your use of the atlas hoops website and all services we provide. by booking a session, entering our facility, or using our website, you agree to these terms in full. please read them carefully.

acceptance of terms

these terms of service (“terms”) constitute a legally binding agreement between you and atlas hoops, llc, a nevada limited liability company (“atlas hoops,” “we,” “us,” or “our”), governing your use of the website located at atlashoops702.com (the “site”) and all related services, programs, facilities, and events.

by (a) accessing or using the site, (b) completing a reservation, (c) entering the atlas hoops facility, or (d) enrolling in any atlas hoops program, you confirm that you have read, understood, and agree to be bound by these terms and all policies incorporated by reference, including our privacy policy and cancellation, reschedule, and refund policy.

if you do not agree to these terms in their entirety, you must not access the site or use any atlas hoops service.

eligibility

you must be at least 18 years of age to independently access the site, create an account, or book services.

if you are booking or enrolling on behalf of a minor (any individual under 18 years of age), you represent that you are the parent or legal guardian of that minor, that you have full legal authority to bind that minor to these terms, and that you accept personal responsibility for all obligations arising from the minor’s participation in atlas hoops services.

atlas hoops reserves the right to refuse service to any individual at its sole discretion, without obligation to provide a reason, subject to applicable non-discrimination laws.

services provided

atlas hoops provides, but is not limited to, the following services:

open runs
“the loop” — adult open basketball runs capped at 15 players per session, reservation-only, offered across six weekly sessions.
court rentals
half-court and full-court rentals (ube side, taro side, halo-halo full court) for private use, training, or events.
player development
private training, small group training, bridge clinics, and other fee-based individual or group training sessions with atlas hoops staff.
atlas basketball academy
monthly subscription-based youth basketball training program for athletes ages 7–13, operating across rookie lab, rotation lab, and starter lab tiers.
special events
birthday parties, private events, camps, clinics, tournaments, and any other scheduled events hosted at or through atlas hoops.
digital content
session video clips and other digital media assets made available through the atlas hoops website or social media platforms.

atlas hoops reserves the right to modify, suspend, or permanently discontinue any service at any time without prior notice. no ongoing right to any service is created by these terms.

reservations & facility access

atlas hoops is a private, reservation-only facility. no walk-in access is permitted. a completed, paid reservation through the atlas hoops booking system is required for entry to any session or court rental.

booking requirement
all participants must have a confirmed, paid reservation prior to arrival. entry may be denied to individuals without a valid booking on the current session roster.
guest policy
non-participating guests (spectators, parents, etc.) are permitted only with advance notice and at the discretion of atlas hoops management. spectators must remain in designated areas and are subject to all facility rules. atlas hoops may limit or prohibit spectators at any session.
pass transfers
open run passes and session reservations are non-transferable and may not be sold, gifted, or shared with another individual. unauthorized use of another person’s booking constitutes a violation of these terms and may result in removal and account suspension.
right of refusal
atlas hoops management reserves the right to deny facility access to any individual at its sole discretion, including individuals who exhibit behavior inconsistent with the code of conduct, who pose a safety risk, or whose presence is disruptive to the facility environment.

code of conduct

all participants, guests, and visitors are required to conduct themselves in accordance with the following standards at all times while on atlas hoops premises or in connection with atlas hoops events.

respect
treat all staff, trainers, participants, and guests with respect. harassment, intimidation, discrimination, and verbal abuse will not be tolerated.
safety
follow all trainer and staff instructions immediately. unsafe play, reckless behavior, or intentional contact designed to injure another participant is grounds for immediate removal.
fighting
physical fighting of any kind — including altercations that begin on the court and continue off-court — will result in immediate permanent ban from all atlas hoops services without refund and may result in law enforcement involvement.
property
participants are responsible for any damage to atlas hoops property, equipment, or facilities caused by their actions or the actions of their guests. cost of repair or replacement will be billed directly to the responsible party.
substance use
alcohol, illegal substances, and controlled substances not prescribed to the individual are strictly prohibited on atlas hoops premises. any individual suspected of being under the influence will be denied entry or removed immediately without refund.
weapons
no weapons of any kind are permitted on atlas hoops premises. this is a zero-tolerance policy. violations will result in immediate removal and law enforcement notification.
recording others
participants may record themselves for personal use. recording other participants, minors, or staff without consent is prohibited. any recording that is used commercially, posted publicly for compensation, or used to defame atlas hoops or its participants is a violation of these terms.

atlas hoops management reserves the right to remove any individual from the facility at any time for violations of the code of conduct. removal due to conduct violations does not entitle the removed individual to a refund, session credit, or any other compensation.

minors on premises

minors (individuals under 18 years of age) are permitted on atlas hoops premises only in connection with a program specifically designed for their age group (e.g., atlas basketball academy) or with a parent or legal guardian present at all times.

parents and legal guardians are responsible for the safety, conduct, and supervision of minors in their care at all times while on atlas hoops premises. atlas hoops staff are not responsible for supervising minors outside of a structured, enrolled program session.

minors participating in atlas hoops programs must have a signed liability waiver and all required registration forms completed by their parent or legal guardian prior to their first session. participation will not be permitted without these documents on file.

atlas hoops reserves the right to remove a minor from a program at any time for conduct inconsistent with the code of conduct or for the safety of other participants, with or without prior notice to the parent or guardian.

facility conditions

atlas hoops operates within a warehouse-style basketball facility. by entering the facility, you acknowledge and accept the following conditions.

temperature
indoor temperatures vary based on outdoor conditions, session activity level, and facility equipment. atlas hoops uses evaporative cooling systems typical of similar athletic environments. participants are responsible for monitoring their own physical limits, hydrating appropriately, and communicating any heat-related discomfort to staff immediately.
flooring & surfaces
court surfaces may be slippery during high-activity sessions. proper non-marking athletic footwear is required at all times on the court. atlas hoops staff may deny facility access to any participant not wearing appropriate footwear. denial of entry for footwear reasons does not entitle the participant to a refund, session credit, or any other compensation. atlas hoops is not responsible for injuries resulting from inappropriate footwear.
lighting & noise
the facility uses music and audio systems during sessions. sound levels may be elevated. participants with hearing sensitivities should plan accordingly.
personal items
atlas hoops is not responsible for theft, loss, or damage to personal property brought into the facility. participants assume full responsibility for their personal belongings at all times.
cleanliness
participants are expected to leave the court and surrounding areas in clean condition. a $50 inconvenience fee may be assessed for excessive mess or failure to return equipment to designated locations.

equipment & property

atlas hoops provides basketballs, ball racks, and other equipment for use during open runs and court rentals. use of this equipment is at your own risk.

damage liability
participants and court renters are financially liable for any damage to atlas hoops equipment or facility property caused by their actions or the actions of their guests. damage will be assessed at replacement or repair cost and billed directly.
personal equipment
participants may bring personal basketball equipment (e.g., personal ball, brace, footwear). atlas hoops does not verify the safety of personal equipment and is not liable for injuries resulting from use of personal gear.
lost or stolen items
atlas hoops is not responsible for lost, stolen, or damaged personal property. any items left in the facility will be held in our lost and found for a maximum of 14 days, after which unclaimed items may be discarded or donated.

outside trainers & coaches

outside personal trainers, coaches, skills trainers, or instructors are strictly prohibited from conducting paid, compensated, or commercially arranged training sessions within the atlas hoops facility without prior written authorization from atlas hoops management.

this policy applies to court rentals, open runs, and any other use of the facility. renters found to be facilitating unauthorized paid training will have their rental terminated immediately without refund and may be subject to an unauthorized use fee of no less than the applicable training session rate.

requests for outside trainer authorization must be submitted in writing to [email protected] in advance. atlas hoops reserves the right to decline any such request without explanation.

assumption of risk

participation in basketball, athletic training, fitness activities, and sports events involves inherent and serious risks, including but not limited to: musculoskeletal injury, fractures, sprains, concussion, cardiac events, heat-related illness, permanent disability, and death. these risks exist regardless of the level of care taken by atlas hoops or its staff.

by participating in any atlas hoops activity or entering the facility, you voluntarily and knowingly assume all risks associated with participation, both known and unknown, foreseen and unforeseen, regardless of whether such risks arise from the negligence of atlas hoops, its staff, other participants, or any other cause.

for minors: the parent or legal guardian assumes these risks on behalf of the minor and accepts full responsibility for the minor’s participation.

release of liability

to the fullest extent permitted by the laws of the state of nevada, you agree to release, waive, discharge, and hold harmless atlas hoops, llc, its owners, officers, members, directors, employees, independent contractors, trainers, volunteers, affiliates, sponsors, facility landlord, and agents (collectively, “released parties”) from any and all claims, demands, liabilities, damages, losses, costs, and expenses of any kind — including attorneys’ fees — arising out of or related to:

participation
any injury, illness, or harm arising from participation in open runs, training sessions, camps, clinics, or any other atlas hoops program or activity.
facility use
any injury or harm arising from your presence in, use of, or access to the atlas hoops facility, including court surfaces, equipment, locker areas, and parking.
negligence
any act or omission of the released parties, including ordinary negligence. this release does not apply to claims arising from gross negligence or willful misconduct to the extent such release is prohibited by nevada law.
third-party actions
any injury or harm caused by the actions of other participants, guests, or third parties present at the facility.

this release is intended to be as broad and inclusive as permitted by nevada law. if any portion of this release is found unenforceable, the remaining provisions shall remain in full effect.

medical disclaimer & emergency authorization

by participating in any atlas hoops activity, you affirm that:

physical fitness
you are in sufficient physical health to participate in basketball and athletic activities and have consulted a licensed physician if you have any known medical condition, history of injury, or concern about your ability to safely participate.
medical disclosure
you have disclosed to atlas hoops in writing any medical condition, allergy, or physical limitation that could affect your participation or require accommodation. atlas hoops is not responsible for adverse events resulting from undisclosed medical conditions.
no medical supervision
atlas hoops does not provide medical supervision, medical advice, or clinical services as part of any program. the presence of dpt-credentialed staff does not constitute medical supervision or create a patient-provider relationship.
emergency treatment
in the event of a medical emergency, you authorize atlas hoops to call emergency medical services (911) on your behalf. you accept full financial responsibility for any emergency medical treatment obtained in connection with your participation.

payments, fees & refunds

all fees must be paid in advance through the atlas hoops booking system unless otherwise explicitly stated in writing by atlas hoops management.

all sales final
unless a specific refund is authorized under the cancellation and refund policy, all sales are final. this includes, without limitation, camp registrations, event tickets, membership fees, and merchandise.
cancellations & refunds
refunds for open runs, court rentals, and player development services are governed by the atlas hoops cancellation, reschedule, and refund policy, incorporated herein by reference.
missed sessions
missed sessions, no-shows, or sessions forfeited due to late cancellation are not eligible for make-up sessions or credits unless explicitly authorized in writing by atlas hoops management.
price changes
atlas hoops reserves the right to change pricing for any service at any time. existing reservations will be honored at the price paid. price changes do not apply retroactively to completed transactions.
subscription billing
aba subscription fees are billed monthly through stripe. by enrolling, you authorize atlas hoops to charge your payment method on the billing date each month until cancellation is submitted in accordance with the aba cancellation policy.

chargebacks & payment disputes

you agree to contact atlas hoops directly to resolve any billing concern before initiating a chargeback or payment dispute with your bank, credit card issuer, or payment platform.

initiating a chargeback for a charge that is valid under these terms — including charges for no-shows, late cancellations, or rescheduling fees — constitutes a material breach of these terms. atlas hoops reserves the right to:

account suspension
permanently suspend the account associated with the disputed charge and deny future access to atlas hoops services without refund of any unused pass balance or credits.
debt recovery
pursue recovery of the disputed amount, plus any associated bank fees, through all available legal means including third-party debt collection and small claims court proceedings in clark county, nevada.
documentation
submit all available booking records, communications, and policy documentation to the payment processor in response to any chargeback or dispute filing.

media release & likeness

by entering the atlas hoops facility or participating in any program, event, or session, you grant atlas hoops, llc an irrevocable, perpetual, worldwide, royalty-free, non-exclusive license to:

photography & video
photograph and video-record your participation and use such recordings for marketing, advertising, social media, educational, and promotional purposes across any medium, including but not limited to instagram, youtube, tiktok, and the atlas hoops website.
likeness & voice
use your name, image, likeness, and voice in connection with the above purposes without additional compensation or further consent.
waiver of approval
you waive any right to review, approve, or reject any specific use of your likeness or image, and waive any claim for compensation in connection with such use.

minors: use of a minor’s image or likeness in external marketing materials requires explicit prior written consent from a parent or legal guardian. session footage containing minors may be used internally for coaching and evaluation purposes without additional consent under the aba enrollment agreement.

opt-out — external marketing use only: you may opt out of having your likeness used in public-facing marketing content (social media, website, advertising, promotional materials). to opt out, submit a written request to [email protected] with the subject line “media opt-out — [your name]” at least 48 hours before your session. requests received less than 48 hours before a session will apply to all future sessions but cannot be applied to the upcoming session.

internal use is retained regardless of opt-out. atlas hoops retains the unconditional right to record all sessions for internal operational purposes, including aba athlete performance evaluation, coaching review, incident documentation, and facility security monitoring. a media opt-out limits only external, public-facing use of your likeness — it does not restrict atlas hoops’ ability to capture or retain footage for internal purposes.

intellectual property

all content on the atlas hoops website and within our programs — including but not limited to logos, branding, training systems, curriculum frameworks, program names (the loop, atlas basketball academy, uba side, taro side, halo-halo court), graphics, videos, photographs, written content, and training methodologies — is the exclusive property of atlas hoops, llc and is protected by applicable intellectual property laws.

you may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit any atlas hoops content without prior written permission. any unauthorized use may result in civil and criminal liability.

website use

in connection with your use of the atlas hoops website, you agree not to:

unauthorized access
attempt to gain unauthorized access to any portion of the site, server, database, or related system through hacking, password mining, or any other means.
automated scraping
use bots, scrapers, spiders, or other automated tools to extract data from the site without prior written authorization.
malicious code
transmit viruses, malware, ransomware, or any other malicious or harmful code through the site or booking system.
impersonation
impersonate atlas hoops, its staff, or any other person or entity in connection with the site or services.
unlawful use
use the site or services for any purpose prohibited by applicable law, including fraudulent booking, identity theft, or unauthorized access to another user’s account.

violations of this section may result in immediate termination of account access and may be referred to appropriate law enforcement authorities.

third-party services

atlas hoops uses third-party platforms including stripe, woocommerce, amelia pro, google workspace, and dropbox to deliver its services. these platforms are governed by their own terms and privacy policies. atlas hoops is not responsible for outages, errors, data breaches, or policy changes on any third-party platform.

the atlas hoops website may contain links to third-party websites or resources not operated by atlas hoops. inclusion of a link does not constitute endorsement of the linked site or its content. atlas hoops assumes no responsibility for the content, practices, or availability of third-party sites.

disclaimer of warranties

the atlas hoops site and all services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. to the fullest extent permitted by applicable law, atlas hoops expressly disclaims all warranties, including but not limited to:

merchantability
no warranty that services will meet your specific expectations or requirements.
fitness for purpose
no warranty that any program, training, or service is suited to your individual fitness level, health status, or athletic goals.
accuracy
no warranty that information on the site is complete, current, or free from error.
availability
no warranty that the site or booking system will be uninterrupted, error-free, or free from technical failures.

limitation of liability

to the fullest extent permitted by the laws of the state of nevada, atlas hoops, llc and the released parties shall not be liable to you or any third party for any indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of revenue, lost profits, loss of data, or business interruption — arising from your use of the site or services, regardless of whether atlas hoops was advised of the possibility of such damages.

in no event shall the total aggregate liability of atlas hoops to you for any claim arising from these terms or your use of the services exceed the greater of (a) the total amount paid by you to atlas hoops in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred dollars ($100).

the limitations set forth in this section are a fundamental element of the basis of the bargain between atlas hoops and you, and would not have been provided but for these limitations.

indemnification

you agree to defend, indemnify, and hold harmless atlas hoops, llc and all released parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

your conduct
your participation in atlas hoops services, including any injury you cause to another participant, damage to property, or violation of applicable law.
terms violations
your breach of any provision of these terms or any policy incorporated herein.
minor claims
any claims brought by or on behalf of a minor whose registration you completed, including claims arising from the minor’s participation in any atlas hoops program.
misrepresentation
any false representation you made in connection with your registration, booking, or enrollment, including misrepresentation of your medical fitness to participate.

lost & found

atlas hoops maintains a lost and found for items left on premises. items found in the facility will be held for a maximum of 14 calendar days from the date they are discovered. after 14 days, unclaimed items may be discarded, donated, or otherwise disposed of at the sole discretion of atlas hoops management.

atlas hoops is not responsible for lost, stolen, or misplaced personal property. to inquire about a lost item, contact us at [email protected] with a description of the item, the date of your visit, and your contact information.

non-discrimination policy

atlas hoops, llc is committed to providing services in an environment that is welcoming, respectful, and free from discrimination. atlas hoops does not discriminate in the provision of services, programs, or facility access on the basis of race, color, religion, national origin, ancestry, sex, gender identity or expression, sexual orientation, age, disability, marital status, or any other characteristic protected by applicable federal, state, or local law.

this commitment applies to all atlas hoops programs, open runs, court rentals, training services, and events. it applies to decisions regarding booking, enrollment, participation, session access, and any other aspect of the customer relationship.

atlas hoops reserves the right to refuse service or remove individuals from the premises for conduct violations, safety reasons, or other legitimate business reasons as described in the code of conduct and termination sections of these terms — provided that such decisions are made without regard to any protected characteristic.

if you believe you have experienced discrimination in connection with any atlas hoops service, please contact us at atlashoops702@gmail.com with the subject line “discrimination concern.” all reports will be reviewed by facility management and addressed in good faith.

accessibility & ada compliance

atlas hoops, llc is committed to compliance with the americans with disabilities act (ada) and all applicable nevada state accessibility laws. we strive to ensure that our facility and services are accessible to all participants, including those with disabilities.

if you require a reasonable accommodation to participate in any atlas hoops program or to access the facility, please contact us at atlashoops702@gmail.com or by phone at 702-948-8937 at least 48 hours before your scheduled session. we will work with you in good faith to identify and implement any reasonable accommodation that does not impose an undue hardship on facility operations.

accommodation requests are kept confidential and will not affect your ability to book services, participate in programs, or be treated fairly by atlas hoops staff.

if you experience a barrier to access at the atlas hoops facility that you believe constitutes a violation of the ada or applicable accessibility law, please notify us at atlashoops702@gmail.com so we can address it promptly.

termination & account suspension

atlas hoops reserves the right to suspend or permanently terminate your account and deny access to all services — without refund of any unused pass balance, session credits, or subscription fees — for any of the following reasons:

conduct violations
fighting, harassment, discrimination, substance use on premises, possession of a weapon, or any other conduct inconsistent with the code of conduct.
terms breach
any material violation of these terms of service, including unauthorized use of another person’s booking or account.
chargeback abuse
initiating an unauthorized chargeback or payment dispute for a valid charge.
repeated no-shows
three or more no-shows or late cancellations within a 60-day period.
management discretion
any other behavior that, in the reasonable judgment of atlas hoops management, is disruptive, unsafe, or incompatible with the atlas hoops community environment.

dispute resolution & arbitration

any dispute, claim, or controversy arising out of or relating to these terms or your use of atlas hoops services shall be resolved by binding arbitration administered in clark county, nevada, in accordance with the commercial arbitration rules of the american arbitration association (aaa), except where applicable law prohibits mandatory arbitration of a particular claim.

by agreeing to arbitration, you waive your right to a jury trial, your right to participate in class action litigation, and your right to consolidated proceedings with any other individual’s claims.

prior to initiating arbitration, the parties agree to attempt in good faith to resolve any dispute informally by written notice to [email protected]. if the dispute is not resolved within 30 days of written notice, either party may initiate arbitration.

these terms are governed by and construed in accordance with the laws of the state of nevada, without regard to its conflict of law principles.

severability

if any provision of these terms is determined by a court or arbitrator of competent jurisdiction to be unlawful, void, or unenforceable for any reason, that provision will be deemed severed from these terms and will not affect the validity or enforceability of the remaining provisions, which will continue in full force and effect.

modifications to these terms

atlas hoops reserves the right to update or modify these terms at any time. when changes are made, we will update the “last reviewed” date at the top of this page. material changes will be communicated to active account holders by email at least 7 days before the changes take effect.

your continued use of the atlas hoops site or services after the effective date of any updated terms constitutes your acceptance of the revised terms. if you do not agree to the updated terms, you must discontinue use of the site and services and notify us at [email protected].
